Accidents Reported in Southern California

Trial Continued for 22-year-old Alleged Drunk and Texting Driver Charged with Killing Cyclist

Posted on Oct 22, 2011

The trial to determine the fate of the Newport Coast woman who struck and killed a cyclist was continued to December 1, according the Newport Beach Patch.

Danae Marie Miller was allegedly intoxicated when she caused the fatal California bicycle accident that killed 44-year-old Amine Britel, also of Newport Coast, on February 21. It is also reported that Miller is accused of repeatedly text messaging while driving, which contributed to her striking Britel from behind while she was riding her bicycle in the bike lane on San Joaquin Hills Road.

Miller's bail was set on $100,000 after she pled not guilty to one count of felony vehicular manslaughter with gross negligence while intoxicated.

Miller pled not guilty in April to one felony count of vehicular manslaughter with gross negligence while intoxicated and has been out of jail on $100,000 bail.

The District Attorney's office reports that Miller's blood alcohol level was at 0.10 almost two hours after the crash, which is 0.02 over the legal limit for California.

Miller faces up to 10 years in prison.

The fatal California bicycle accident lawyers at Steinberg Spencer have seen firsthand the devastation that these types of accidents can cause, and we urge drivers not to drink and drive. They should also be aware and share the road with cyclists. For more information on how you can help reduce the number of injury accidents in California, please contact us.
