Q: I was injured at work and have applied for workers’ comp benefits.  How do I find out if I qualify for permanent disability benefits?  What is the process?

A: A work accident can lead to serious injuries.  Under California workers’ compensation, you may be entitled to benefits during your recovery.  If your disability is considered to be permanent, you may be eligible for permanent disability benefits.

The doctor will be the one to determine if your injury or illness led to a permanent disability (PD).  Your doctor will put his or her findings into a report, which is used to calculate a PD rating.  One of the other factors that will be evaluated is whether you had another condition or previous injury that caused your permanent disability.

The claims administrator will review your doctor’s report and the benefits you will receive will be based on the PD rating.  If you do not agree with the doctor, you can get another opinion from a qualified medical evaluator.
